GENERAL CONDITIONS

1. This Agreement is available as an additional service to users of Senick, Inc.'s heating oil. This Agreement will automatically terminate if the customer ceases to use Senick, Inc.'s heating oil, fails to pay for all fuel oil, parts, labor or other chargeable items when due, or renders or permits anyone other than the Senick, Inc. to service the burner and equipment, unless so instructed beforehand by Senick, Inc.. There shall be no obligation upon Senick, Inc. to perform any service or provide parts after termination of this Agreement. Upon termination, there shall be no refunds or credits allowed.

2. THIS AGREEMENT IS OFFERED TO NEW BURNER SERVICE ACCOUNTS SUBJECT TO INSPECTION AND APPROVAL OF EQUIPMENT; ANY REPAIRS REQUIRED TO PLACE EQUIPMENT IN ACCEPTABLE CONDITION ARE EXCLUDED AND WILL BE CHARGED SEPARATELY. Prices quoted refer to most domestic type burners and shall be limited to equipment rated at a maximum firing rate of 1.50 gallons per hour.

3. Prices quoted refer to domestic type heating equipment only. Prices on other types available on request.

4. This Agreement does not include equipment failures resulting from customer's refusal of automatic delivery.

5. This Agreement is non-transferable, and does not cover General Electric, low pressure of vaporizing oil burners.

6. This Agreement does not cover repair service of oil burner equipment damaged due to fire, flood, lightning, freeze-up, and other acts of God; nor Local, State, or Federal Government Acts or Requests. Nor service calls caused by improper setting of thermostats or switches in "off" position; inadequate water in boiler or inadequate oil in tank; or tampering with equipment. We are not responsible for replacing obsolete parts unavailable through normal local sources of supply, or furnishing a new oil burner under Plan 1.

7. Senick, Inc. warrants that all service performed and parts installed by it shall be in a good workmanlike manner, and fit to their particular intended use. Senick, Inc. shall be liable solely for repair to the heater or burner and related equipment caused by its negligence, but not otherwise. And under no circumstance shall the Senick, Inc. be liable for any consequential or resultant damages or injury (including death) to persons or property, nor from damages resulting from defective heater or burner, or for loss or damage resulting from operation or non-operation of said equipment. Delays in performing service, making repairs or installation of parts, because of strikes, accidents, explosions, shortages, or other conditions beyond the control of Senick, Inc. shall excuse the Senick, Inc. for performances of this Agreement.

8. All Promises and understandings are contained in this Agreement. No additional promises on the part of Senick, Inc. or modifications to this Agreement shall be binding unless made in writing and executed by an authorized representative of Senick, Inc.

9. Effective date of this Agreement is the 1st day of June and expiration is the 31st of May of the following year, unless renewed. Should inspection of heating system determine that system does not qualify for Comprehensive Coverage, customer will be billed for Pre-Season Burner Conditioning.

10. This Agreement does not cover unoccupied premises.

Terms: Oil delivery and equipment service plan offers apply to address shown on reply card. Unless credit is established with us, cash on delivery or performance of equipment servicing is required.

Equal Payment Plan: Heating Season deliveries are divided into ten monthly payments from September to June. Payments are due on the 10th of the month. Heating equipment service will be budgeted in with the cost of heating oil, if desired, by indication on reply card.
